Notice To Customers Relating to Personal Data Protection Act 2010 (hereinafter referred to as “PDPA”).
This Notice is issued pursuant to the requirements of PDPA.
1. Collection and Processing of your Personal Data
1.1 PDPA governs and regulates the processing of personal data in commercial transactions. For purpose of this Notice the terms “processing” is defined within Section 4 of the PDPA.
1.2 In the course of your dealings with Jupiter Trading Sdn Bhd and its holding company, subsidiaries, associates, affiliates and /or members within the Chong Company group of Companies (collectively, referred to as “us”, “our” or “we” in this Notice), we will request that you provide data and information about yourself including any updates, to us, our marketing and sales agent and/or any of our service providers to enable us to enter into commercial transactions with you or deliver the necessary notices, services and/or products in connection with our business.
2. Personal Data
2.1 Data collected by us may include but not limited to the followings:-
- personal details such as name, nationality, gender, marital status, date of birth, identification card number, passport number and its details;
- contact details such as phone numbers (house/office), facsimile numbers(house/office) and email addresses (personal/office);
- occupational details such as occupation, qualification, employer;
- income tax details, EPF number;
- background information;
- relevant financial details and banking information such as bank information, account numbers;
- any other information which were obtained from registration form, sales form, website, subsale and/or refinancing of your property whatsoever of which you have provided for purpose set forth in paragraph 3 below.
2.2 Furthermore we may continue to request additional information from you in order to carry out business transactions with you efficiently and accurately.

3. The Purpose in Collecting and Further Processing (including disclosing) the Personal Data
The Personal Data that is processed by us will be processed and utilized for the following purposes:-
- circulating relevant notices, current/future services and products to you;
- performing any contract in order to complete any sale or purchase transactions with you including but not limited to the preparation and execution of any contracts;
- performing any contract in order to complete the transactions such as renting, leasing, licensing and any transactions relating to property with you including but not limited to the preparation and execution of any contracts;
- for those services and products for which the Personal Data was specifically provided to us;
- those purposes specifically provided for in any particular service or product offered by us;
- customer relationship management procedures;
- company auditing;
- marketing and customer profiling activities regarding our latest projects, products and/or services;

- efficient delivery of vacant possession, handing over of keys, property management, upgrading works, defect rectification works, customer care and/or any other activities for conducting and completing the sale and purchase of your property or properties;
- meeting any legal or regulatory requirements relating to the provision of services and products and to make disclosure under the requirements of any applicable laws, regulations, by laws, directions, guidelines, circulars whatsoever applicable to us;
- enable us to furnish and submit the Personal Data to government bodies/agencies/local authorities and institutions ; or
- to enable easier contact for a more customer friendly relationship.
4. Source of your Personal Data
4.1 Your Personal Data will be acquired from the following sources and/or other sources as we deem fit:
- information that was provided or submitted by you inclusive of any registration or sales forms, correspondence (including email), enquiries, new launches, property roadshows, showcases, exhibitions, any promotional activities and operation of our webpage; or
- agreements and contracts for sale and purchase /tenancy agreement/ license agreement of our properties or for our services; or
- any referrals from a person which have included their personal contact details; or
- letters of offers from bank or financial institution; or
- in the course of commercial transactions concerning notices, services, products and/or properties enquired for or delivered; or
- any relevant information which is publicly available or accessible; or
- such other written or verbal communication or documents received in the course or prior to contractual transactions with you; or
- directly or through our authorized agents and representatives or directly from you or indirectly from third parties such as our authorized agents, dealers or representatives, your legal representatives, agents in any manner in connection with any transaction, arrangements and/or enquiries made with us.
5. Consequences of Failing to Supply Your Personal Data
5.1 In order for you to carry out the commercial transactions with us, you are obliged to provide us with the Personal Data. Should you fail to provide the obligatory information, we may be unable to process your request and/or provide you with the relevant services and products.
5.2 If you fail to supply the Personal Data to us, we will not be held liable for any consequences that may result thereof. This may range from us inter alia unable to:
- provide you with information, notices, services and/or products requested;
- prepare, formalize and execute any contract, agreement, tenancy agreements, Sale and Purchase Agreement in relation to the sale of property(ies) and/or any other project;
- send you information relating to services and products offered via email, telecommunication (telephone calls and text messages) or through social media by us, our authorized third party agent and our business affiliates which we consider may be of interest to you;
- update you with our latest product and/or launches;
- complete commercial transactions in relation to our projects, products and/or services;
- comply with any applicable laws, regulations, directions, guidelines and/or orders.
6. Right to Access and Correction of your Personal Data
6.1 Subject to certain qualifications and exemptions under PDPA and payment of prescribed fees, PDPA confers the following rights on you in relation to your Personal Data and the processing thereof :-
- the right to access to your Personal Data;
- the right to correct your Personal Data if you consider your Personal Data to be inaccurate, incomplete, misleading or not up to date;
- the right to withdraw consent to process your Personal Data;
- the right to prevent processing likely to cause damage or distress; and
- the right to prevent processing for direct marketing

7. Disclosure of Personal Data to Third Parties
7.1 You hereby consent and authorize us in disclosing your Personal Data to the following third parties:
- any persons, government agencies, statutory authorities and/or industry regulators whom we are compelled or required by any legislations or laws;
- the local authorities, Land Office, Stamp Office, Valuation Office, KWSP, Ministry of Housing and Local Government, Ministry of Finance;
- any relevant non-governmental bodies/agencies and private institutions;
- utilities and amenities providers;
- anybody within our group of companies and their subsidiaries, including those established/incorporated in the future;
- our accountants, consultants, lawyers and any other relevant financial or professional advisors;
- our contractors or third party service or product providers, third party property management companies as are considered necessary or appropriate for the facilitation of business such as our property managing agent, Joint Management Body and/or the management corporation;
- our appointed service providers in relation of our loyalty programmes, for the purpose of delivery gift redemption and services; or
- our business partners and affiliates that provide related services or products in connection with our business
8. Choices and Means of Limiting Processing of your Personal Data
8.1 Your Personal Data will undergo processing as required for the purposes illustrated in this Notice. At any material time you have the right to wholly or partially withdraw or limit the use of your Personal Data, as the case may be, in any of the processes for which it is utilized or subjected to.

9. The Safeguarding and Protection of your Personal Data
9.1 We will take all necessary and appropriate safeguards to protect the integrity and security of your Personal Data.

We are committed to take all measures to ensure that your Personal Data will always be kept confidential and shall never be subject to trade, rent or any other form of sale.
9.3 We will take steps to protect the Personal Data from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction.

We reserve our rights to amend this Notice to Customer at any time and will place notice of such amendments on our website or via any other mode as we deem suitable. Nothing in this Notice shall limit our rights or your rights under the PDPA.
